Privacy policy

This Privacy Policy explains how Allermix Inc. (“Allermix Inc.”, “we”, “us”, “our”) collects, uses, discloses, and safeguards personal information when you visit our websites, purchase our products, subscribe to deliveries, contact us, or interact with us on social media (the “Services”). This Policy applies across Canada under the Personal Information Protection and Electronic Documents Act (PIPEDA), as well as substantially similar provincial private-sector laws where applicable (e.g., Alberta, British Columbia) and Québec’s Law 25. Canadian anti-spam laws (CASL) govern marketing communications.

1) What we collect

We collect the minimum personal information needed for the purposes below:

  • Identifiers & contact: name, email, phone, billing/shipping address, account details.

  • Commercial & payment: orders, subscriptions, returns; tokenized payment IDs and the last 4 digits from PCI-compliant processors (we do not store full card numbers).

  • Technical & usage: IP address, device/browser data, cookie IDs, pages viewed, referral/UTM, approximate location (from IP).

  • Communications & UGC: messages to support, product reviews, photos you submit, survey responses.

  • Preference & consent records: cookie choices, marketing opt-in/out, language.

  • Sensitive: if you voluntarily share dietary or health context (e.g., allergy notes) in support messages or surveys, we treat it as sensitive and use it only to respond. We do not require health information to make a purchase.

2) Why we collect it (purposes)

We use personal information to:

  1. Provide the Services: process orders and payments, fulfill and deliver products, manage subscriptions, handle returns and limited warranty claims.

  2. Customer support & safety: respond to inquiries; send recall or urgent safety notices about products you purchased.

  3. Improve and protect our Services: debugging, fraud prevention, quality control, analytics (often de-identified or aggregated).

  4. Marketing (CASL): send offers or promotions only with your express consent; you may unsubscribe at any time.

  5. Legal & compliance: tax/accounting, record-keeping, enforcing our terms, and meeting legal obligations.

We do not sell personal information. We may use or share de-identified or aggregated information for statistics and product development.

3) Consent and your choices

  • We rely on express consent for marketing and for collecting any sensitive information you voluntarily provide.

  • We rely on implied consent (or contractual necessity) for operational processing such as order fulfillment, fraud prevention, and security.

  • You may withdraw consent to non-essential processing at any time; this won’t affect prior lawful processing.

  • Québec (Law 25): for profiling or advertising cookies, we present clear notice and obtain consent through our cookie banner.

4) Cookies, analytics, and ads

We use cookies and similar technologies for:

  • Essential: cart, checkout, authentication, security (cannot be switched off in our systems).

  • Analytics: to understand site usage and improve performance.

  • Advertising (optional): retargeting or audience measurement only with consent.

Use our cookie banner/preferences to control non-essential cookies, or set your browser to block them. In Québec, profiling/advertising cookies are off unless you opt in.

5) Children and minors

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child provided information, contact us to request deletion.
Québec: personal information of minors under 14 is collected only with consent of the person having parental authority or a tutor, unless clearly in the minor’s best interest.

6) When we disclose information

We share personal information only as needed and with safeguards:

  • Service providers (processors): payments, ecommerce/hosting, fulfillment and carriers, customer support platforms, analytics/anti-fraud. They may process data only to provide services to us and must protect it appropriately.

  • Safety and recalls: to contact you about urgent safety communications related to products you purchased.

  • Legal/compliance: if required by law, court order, or to protect rights, safety, or property.

  • Business transactions: in a merger, acquisition, or asset transfer, information may be transferred under confidentiality and remain protected by this Policy.

7) Cross-border transfers

Our service providers may process information in Canada or other countries (e.g., the United States). When information is processed outside your province or Canada, it may be available to foreign authorities under lawful access.
Québec (Law 25): before transferring personal information outside Québec, we perform a privacy impact assessment and implement contractual safeguards to ensure adequate protection.

8) How long we keep information (retention)

We retain personal information only as long as necessary for the purposes above or as required by law, then securely destroy or de-identify it. Examples:

  • Orders and tax records: typically up to 7 years.

  • Customer support communications: generally up to 2 years after resolution.

  • Marketing preferences: until you withdraw consent.

9) How we protect information (security)

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information (encryption in transit, access controls, least-privilege, monitoring, and vendor due diligence). No system is perfect; if we identify a breach of security safeguards creating a real risk of significant harm, we will notify affected individuals and the appropriate regulator(s) as required.

10) Your rights

Subject to limited exceptions:

  • Access & portability: request access to your personal information and, where feasible, an electronic copy.

  • Correction: request correction of inaccurate or incomplete information.

  • Withdraw consent: opt out of marketing or non-essential processing.

  • Cookie controls: manage non-essential cookies via the banner/preferences.

  • Québec (Law 25): you may request cessation of dissemination, de-indexation/re-indexation in circumstances provided by law, and information about cross-border transfers and any automated processing affecting you.

To exercise rights, contact the Privacy Officer (Section 1). We may need to verify your identity.

Complaints: You may contact us, and you may also complain to the Office of the Privacy Commissioner of Canada (OPC), the Commission d’accès à l’information (Québec), or your provincial commissioner where applicable.

11) Automated decision-making and profiling

We do not make decisions producing legal or similarly significant effects solely by automated means. If we introduce such processing, we will provide clear notice, obtain consent where required, and explain the logic involved and the consequences. Where we use advertising/profiling cookies, we obtain consent via the cookie banner and offer opt-out options.

12) CASL: transactional vs. marketing messages

  • Transactional/service notices (e.g., order confirmations, delivery updates, recalls/safety notices) are sent without marketing consent.

  • Marketing messages (email/SMS) are sent only with your express consent and include an unsubscribe mechanism. Unsubscribing does not affect transactional or safety notices.

13) Third-party links and social media

Our Services may link to third-party sites or tools. Their privacy practices are governed by their own policies. If you tag us or submit reviews/photos, we may display them consistent with our Terms of Service; avoid sharing sensitive information in public posts.

14) Accessibility and language

We will provide this Privacy Policy in an accessible format upon request. For Québec consumers, a French version is available upon request.

15) Changes to this Policy

We may update this Policy to reflect changes to our practices or the law. The “Last Updated” date will change. Where changes are material, we will provide additional notice (e.g., site banner or email).
