1. Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or destructive code. A breach of these Terms will result in immediate termination of your access to the Service.

Nothing in these Terms limits any non-waivable rights or remedies under applicable law (including the Consumer Protection Act, 2002 (Ontario) and the Competition Act (Canada)). To the extent of any conflict, those rights prevail.

2. Health, Safety & Medical Disclaimer

Our products are food items intended for general consumption. They are not medical advice and is not a substitute for professional medical advice, diagnosis, or treatment.

Always read the ingredient label and allergen statement each time before use. Formulations, suppliers, and lot characteristics may change. Do not use our products if you (or the intended consumer) have a known allergy to any listed ingredient, have experienced anaphylaxis or severe reactions to other foods, or have been advised by a clinician to avoid the relevant foods.

Stop use immediately and seek medical advice if any symptoms of allergy occur (e.g., hives, vomiting, cough, wheeze, swelling, pallor, lethargy). In an emergency, call your local emergency number (e.g., 911) and use an epinephrine auto-injector if prescribed.

Parents/caregivers should introduce foods consistent with their clinician’s guidance and local public health recommendations. Our product does not diagnose, treat, cure, or prevent disease and is not a guarantee against the development of food allergy.

By purchasing or using our products, you acknowledge the inherent risks of food consumption, especially in infants and young children, and agree to use products only as directed.

Ingredients, allergen profiles, and sourcing may vary by lot. Cross-contact can occur in the supply chain or manufacturing environment. We disclose known priority allergens on the label in accordance with Canadian law. Always check the physical package for the most current information; the package label supersedes website content.

Products are conventional foods, not medical devices or pharmaceuticals. Any feeding schedules or serving suggestions are informational only and are not personalized medical advice. Consult a qualified healthcare professional if you have questions about infant feeding, allergy risk, or symptom management. Site content is for general information only and is not a substitute for professional medical advice, diagnosis, or treatment.

3. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding payment card data) may be transferred unencrypted and involve transmissions over various networks and changes to conform to connecting networks or devices. Payment card data is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

4. Accuracy, Completeness & Timeliness of Information

Site material is provided for general information only and should not be relied upon as the sole basis for decisions. Any reliance on site material is at your own risk. We are not responsible if information is inaccurate, incomplete, or outdated. Historical information is provided for reference only.

5. Modifications to the Service & Prices

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part thereof) without notice at any time. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance.

6. Products & Services

Certain products or services may be available exclusively online and/or in limited quantities. All descriptions, images, and prices of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time.
Returns/Refunds/Exchanges are governed by our Return Policy. For safety reasons, food products are typically returnable only if unopened and within the stated window. See the Refund Policy for details and exceptions required by law.

If there is any discrepancy between website information and the physical label/lot insert, the label/insert prevails. Observe best-before dates and storage conditions; product quality may degrade after the best-before date.

Products conform to their label at the time of shipment. We do not warrant quality after the best-before date, or where storage/handling directions are not followed, packaging is opened or compromised, or the product is used contrary to directions. This limited warranty does not affect non-waivable statutory rights. Where feasible, we will use reasonable efforts to post material changes to priority allergens for a product lot on the product page. However, the physical label and lot insert govern in all cases

7. Orders, Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. We reserve the right to refuse, limit, or cancel quantities purchased per person, per household, or per order (including orders placed by or under the same customer account, credit card, and/or orders that use the same billing and/or shipping address). All orders are subject to review and fraud screening. We may request identity or address verification and may cancel/refund orders we cannot verify.

We may, at our sole discretion, limit or cancel orders that appear to be placed by dealers, resellers, or distributors. Taxes are charged where applicable. All prices are in CAD unless otherwise noted.

If you have an issue, please contact us first so we can resolve it quickly. If a payment dispute or chargeback is opened, we may temporarily suspend fulfillment while we investigate and will provide supporting evidence to the payment network as required.

8. Shipping, Delivery & Risk of Loss

Processing times are separate from carrier transit times. Posted transit estimates are provided by carriers and are not guarantees.

Risk of loss and title for products pass to you upon delivery to the shipping address shown on the order. You are responsible for providing accurate shipping information. Undeliverable or refused packages may be returned at your expense per the Shipping Policy.

International shipments (if offered) may be subject to duties, taxes, and import fees, which are your responsibility. For details, see our Shipping Policy.

We may contact you using the contact details you provide (including email and SMS) for urgent safety communications, recalls, or material allergen/ingredient notices related to your purchases, notwithstanding marketing opt-out preferences.

9. Subscriptions / Auto-Renew

If you subscribe to recurring deliveries, you authorize recurring charges at the stated interval until canceled. You can cancel or skip within your account before the stated cut-off time for the next shipment. We will provide notice of price changes prior to renewal where required by law.

Before each renewal we will disclose the renewal date, amount, and how to cancel. You may cancel any time before the renewal cut-off through your account. Promotional pricing reverts to then-current standard rates after the promotional period, as disclosed.

10. Returns & Refunds 

Returns, exchanges, defective/damaged-on-arrival procedures, windows, exclusions, and responsibility for return shipping are governed by our Refund Policy.

Opened food items are not returnable. Unopened items may be returnable within the window stated in our Refund Policy. This policy does not limit any mandatory statutory rights that cannot be excluded.

11. Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties. Any use by you is entirely at your own risk and discretion and you should ensure you are familiar with and approve the terms on which tools are provided by the relevant third-party providers.

12. Third-Party Links

Third-party links on this site may direct you to external websites that are not affiliated with Allermix Inc. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability for any third-party materials or websites.

Third-party tools or integrations may change, suspend, or terminate features without notice; we are not responsible for resulting loss of functionality.

13. User Content (Reviews, Photos & Submissions)

By submitting reviews, comments, ideas, photos, or other materials (collectively, “User Content”), you grant Allermix Inc a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit such User Content, in any media, for marketing and operational purposes.

You represent and warrant that you own or control all rights to your User Content and that it does not infringe any third-party rights, violate law, or contain harmful code. We may edit or remove User Content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable.

To the fullest extent permitted by law, you waive any moral rights in User Content and agree that Allermix Inc may edit or use User Content without additional notice, approval, or compensation. We will not edit User Content in a manner that is misleadingly attributed to you or that is derogatory in context.

14. Personal Information & Cookies

Your submission of personal information through the store is governed by our Privacy Policy.

We use cookies and similar technologies for functionality, analytics, and advertising as described in our Privacy Policy. By using the site, you consent to our use of cookies in accordance with that policy. 

Transactional emails (orders, safety/recall) are sent without marketing consent. Marketing messages are sent only with your express consent and include an unsubscribe mechanism. You can withdraw marketing consent at any time without affecting transactional notices

We use third-party providers (payments, fulfilment, analytics) that may process personal information inside or outside Canada. We take reasonable steps to ensure comparable protections; see our Privacy Policy for details.

We maintain safeguards appropriate to the sensitivity of information and, where required by law, will notify you and regulators of qualifying privacy breaches.

15. Errors, Inaccuracies & Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions, including relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order). In the event of a pricing or availability error, we may cancel affected orders and refund amounts paid, even after order confirmation.

16. Prohibited Uses

In addition to other prohibitions set forth in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or territorial regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We reserve the right to terminate your use of the Service for violating any of the prohibited uses. You are responsible for safeguarding your credentials and for all activity under your account.

17. Intellectual Property

All content on the site including text, graphics, logos, images, video, audio, software, and code is the property of Allermix Inc or its licensors and is protected by intellectual property laws. You are granted a limited, revocable license to access and use the site for personal, non-commercial use. No scraping, data mining, or automated collection without prior written permission.

If you submit ideas, feedback, or suggestions, you assign to Allermix Inc all right, title, and interest in such feedback worldwide and waive any moral rights to the extent permitted by law, without compensation, attribution, or duty to use.

18. Disclaimer of Warranties; Limitation of Liability

Except as expressly stated otherwise and to the extent permitted by law, the Service and all products and services delivered to you through the Service are provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

Allermix Inc (and our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, and service providers) will not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind. To the fullest extent permitted by law, our aggregate liability for any claim arising out of the Service or products is limited to the amount you paid for the product(s) giving rise to the claim. This limitation does not apply to liability that cannot legally be limited (including liability for death or personal injury caused by our negligence, or for intentional misconduct or fraud).

19. Indemnification

You agree to indemnify, defend, and hold harmless Allermix Inc and our affiliates, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

20. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms; such determination shall not affect the validity and enforceability of any other remaining provisions.

21. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. We may also terminate this agreement at any time without notice if, in our sole judgment, you fail to comply with any term or provision of these Terms. 

22. Force Majeure

We will not be liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, natural disasters, epidemics, labour disputes, carrier delays, governmental actions, internet outages, or other force majeure events including recalls or mandatory safety actions.

23. Pre-Orders & Backorders

Pre-order and backorder items will ship during the estimated window shown on the product page. You may cancel prior to fulfillment. Your payment method may be authorized at checkout and captured prior to shipment as indicated at purchase.

24. Accessibility

We aim to meet WCAG 2.0 AA under the Accessibility for Ontarians with Disabilities Act (AODA). If you experience barriers, contact us and we will provide an accessible alternative.

25. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes shall be brought exclusively in the courts of Ontario, without limiting mandatory consumer protections of the buyer’s province or territory where applicable.

26. Entire Agreement

These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and Allermix Inc and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals.

27. Changes to Terms of Service

You can review the most current version of the Terms at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. Your continued use of or access to our website or the Service following the posting of any changes constitutes acceptance of those changes.

We may provide notices by posting on the site, emailing your account address, or other reasonable means. Notices are effective when sent or posted. You agree to transact electronically, and electronic records associated with your purchases are admissible as originals.

29. Resale & Territory

Purchases are for end-user consumption only. Resale or distribution without a written reseller agreement is prohibited. We may restrict destinations at our discretion.

30. Trade Compliance

You represent that your purchase and use comply with applicable export, import, and sanctions laws and that you are not in a prohibited jurisdiction or on a restricted-party list.

31. Assignment; Survival; No Waiver

You may not assign these Terms without our consent; we may assign them, including in a merger, acquisition, or asset sale. Sections relating to intellectual property, warranties, limitations, indemnities, payment, privacy, and dispute terms survive termination. Our failure to enforce any provision is not a waiver of rights.
